Bank guarantee for employing an Indian female domestic worker

Mandatory submission of bank guarantee of US$ 2500/- by employers for employing an Indian female domestic worker (Visa no. 20) and now the same is applicable for all female workers holding ECR passports for private sector (visa 18 ) w.e.f. 16.9.2016.

IMPORTANT : AT PRESENT ATTAESTATION OF EMPLOYMENT CONTRACT FOR ALL FEMALE DOMESTIC HELP (VISA 20) & ALL FEMALES HOLDING ECR PASSPORT (IREESPECTIVE OF JOB CATEGORY INCLUDING VISA 18 (PRIVATE SECTOR) IS KEPT UNDER ABYEANCE AS BANK GUARANTEE IS NOT BEING AGREED BY KUWAITI GOVERNMENT.

PLEASE NOTE: This Bank Guarantee is not required if, ECR Category Female workers (Domestic/Private Sector) are recruited through 6 Indian Government authorized agencies. These are given here

The Government of India has decided that the prospective sponsors should give a bank guarantee of a sum equivalent to US $ 2500/- (KD 720) for employing an Indian woman domestic servant. The bank guarantee shall be used for repatriation of the housemaid and other unpaid expenses like salary, medical expenses etc. in r/o of the housemaid in the case the employer fails to pay the same as per the terms of the agreement.

The application for domestic worker agreement will be accepted with original bank guarantee for KD 720/- for period of three years with automatic roll over, by the sponsor. The bank guarantee should be from NBK or any other bank in Kuwait/India.

The bank guarantee is to be submitted in original to the Embassy of India. On termination of the employment contract at any time by mutual consent, the employer should bring the domestic worker to the Embassy of India, Kuwait and submit a written request for refund of the bank guarantee before the final departure of the domestic worker to India. The domestic worker would require to confirm in writing that all her dues have been settled. Should the domestic worker complain of non-receipt of her dues, the Embassy would deduct the same from the bank guarantee. The bank guarantee in the following format may be submitted.

ON BEHALF OF THE APPLICANT, WE HEREBY GUARANTEE AND UNDERTAKE TO PAY YOU IN CONNECTION WITH THE SUBJECT STATED HEREIN, ANY AMOUNT OR AMOUNTS NOT EXCEEDING IN TOTAL AS STATED ABOVE ON RECEIPT OF YOUR WRITTEN DEMAND AND DESPITE ANY CONTESTATION ON THE PART OF APPLICANT PROVIDED THAT IT IS ACCOMPANIED BY THIS ORIGINAL GUARANTEE. SUCH DEMAND/CLAIM MUST BEAR THE CONFIRMATION OF YOUR BANKERS THAT SIGNATURE(S) THEREON IS/ARE AUTHENTIC.

THIS LETTER OF GUARANTEE IS VALID FROM THE EFFECTIVE DATE UNTIL RECEIPT OF YOUR WRITTEN INSTRUCTION TO US FOR ITS CANCELLATION ALONG WITH THIS ORIGINAL GUARANTEE.

THIS GUARANTEE IS PERSONAL TO YOU AND IS NOT ASSIGNABLE.
